Update Thursday April 22,2010
My father was not present at the Rule 11 hearing yesterday at
the request of his Attorney Mr. John Curry. The report of the Mental
Evaluation have been Sealed per the Court. The Court has ruled
that my father is Competent to Stand Trial. The reports were submitted
by Dr. Bruce Kushner Dated 04/15/10 and Dr. Gwen Levitt Dated 04/16/10,
based on what is entailed in these reports the judge ruled my father
understands the proceedinga and is able to assist counsel with his defense.
The PreTrial Conference is Scheduled next week 04/27/10 at 8:15 am Arizona
time.
I still believe that they have my father is mistakenly
identified as the suspect Roger Cook in this Case.
I also do not understand how they can put a man on trial
in Arizona when a Grand Jury has not even passed a True Bill Inditement
on my father. The website list Grand Jury as Unknown which to me means
he has not been indited for this alleged crime.
The Legal system in Maricopa County Arizona in unjust in Arizona it seems to me.
All you can get on the public access website is minutes without paying an annual fee.
Something smells here and it stinks worse than a cesspool.

It appears that my fathers Competency hearing ruled that my father is
Competent to stand Trial. I received notification from the court a few minutes
ago. They will have a Comprehensive PreTrial Conference hearing on Tuesday
April 27, 2010. I am not sure of the time as of this evening because the Minutes
of the Rule 11 hearing that took place yesterday are not posted as of yet on the
public access website.
I will post additional information as it becomes available.

I confirmed this afternoon that my fathers Pretrial Conference hearing
yesterday was Vacated and his Trial scheduled to start on March 17, 2010 has
been vacated as well.The reason for this is My Father's Attorney filed a Motion
to verify that my Father is Competant to stand Trial. The case has been transferred
to Rule 11 Commissioner's Court for further proceedings related to my fathers competency.
My father still remains in custody. I will continue to update you when I obtain more information.

He is not Roger Cook even though they have him in jail as Roger Cook.

My father had a IPTC (Initial Pretrial Conference) on Friday February 5, 2010 with Commissioner
James Rummage residing judge. It was ordered that FTMC(Final Trial Management Conference)
is to be hheld on March 10, 2010 at 8:30 a.m. before Judge Foster.
It was also ordered that the Firm Trial Date is to take place on March 17, 2010 at 8:00 a.m. before
the Master Calendar Assignment Judge.
Please remember I still believe they have my father mistakenly identified as Roger Cook.
He is not Roger Cook even though they have him in jail as Roger Cook.
They should still be investigating to find out the whereabouts of the actual suspect in this case

My father had a hearing Monday January 4, 2010 in Arizona, Please remember I still believe they have my father mistakenly identified as Roger Cook. He is not Roger Cook even though they have him in jail as Roger Cook. They should still be investigating to find out the whereabouts of the actual suspect in this case Mr. Roger Cook.

If the attorney that represented the original Roger Cook in 1987 stated the above mentioned statements in Court Monday January 4, 2010 I am Confident that the States of Arizona and California in conjuction with the United States Marshals Office have definately violated my Father Richard Earl Rodgers Civil Rights. Something Smells here,It just doesn't add up.
Why do I say Something Smells here ant that It just doesn't add up? Here is why I say this and if you are following this case I believe you will understand Why I make this statement.
State of California Superior Court hearing Scheduled 11/17/2009 and State of California Superior Court hearing Scheduled 12/15/2009,Did not take Place Why?
Arizona Judicial Branch Records show that on 09/01/09 BWA-Bench Warrant Issued(Why do this before California Hearing on November 11/17/09 was not complete?) Please keep in mind that as I understand the extradiction laws this bench warrant may be a civil rights violation due to the fact that my father at this time was a citizen of California and should have had a Fair Expiditation Legal Process in California. I do not believe this was the case here.
Arizona Judicial Branch Record show that on 11/13/2009 Minute Entry issued setting court trial date for March 31,2010. electronically enter in their computer system on 11/16/09. Then on 11/17/2009 in Arizona Judicial Branch system the day my father was to have a hearing in California.
9/2/2009 I spoke directly with a Mr.Tom Higgins from the Los Angeles County District Attorney's office. He informed me at this time that he would 1 make sure my father had a fair extradiction process of make sure my fathers rights were protected and that he would not be sent to Arizona until this process was complete. Strange,I am no attorney however it seems to me Arizona pulled a Sneaky Legal Tactic and issued a new Bench Warrant. I believe Arizona again violated my fathers civil rights.
Something is definately wrong with the legal sytem in Arizona and Possibly California as well.But in fact The US Marshals office in my opinion should have completed a thourough investigation as well. It seems to me the US Marshalls and Detective Mark Armistead dropped the ball here.I believe This whole case is Fishy and Stinks like a Cesspool.

My Father was transferred to the state of Arizona on Thursday November 12, 2009
I received notification of this today via email from The Vine Service. I will update this
when I receive futher information on his case.
I personally still believe they have made a case of mistaken identity on this case and only
hope and pray that my father is safe and I pray for the victim in this case as well.

My Father is still in Custody in Los Angeles California, Hearings are scheduled November 17, 2009 8:30 a,PST, and December 15, 2009. I do not have any more information at this time.
I would like to explain why I have posted this information, In order to show Transparency I will continue to post
information here until there is a disposition of this case.

Update 8/26/2009
It now appears that my father is in custody in Los Angeles California, under another name, he is alleged to have committed a crime in Phoenix Arizona in 1987. I am not sure as of today that they have the correct person, But at least I know he is alive and safe. I appreciate everyones assistance in this matter. I will keep information posted when I receive further information.
Please help me find my Kidnapped Father
Richard Earl Rodgers was kidnapped by Two Men identifying themselves as Sheriffs Officers was taken at approximately 10:00 am Pacific Time Thursday Morning from an Apartment Complex In Long Beach California.
The pictures below were taken somewhere in Long Beach approximately Three Years ago.
My father is now confined to an Electric Wheel Chair. I cantacted the Los Angeles Divison of the Federal Bureau of Investigation at approximately 1:00 pm today 8/24/09 asking for their assistance since the Long Beach Police Department after all day on the phone with them between myself and my two sisters we were finally able to get the Missing Persons Department to take a Report we were told by Long Beach however that they could not investigate until tomorrow or Wednesday. So I called first the FBI office in Atlanta Ga since the office in Columbus Georgia had an answering machine that directed me to Atlanta. The Lady agent in Atlanta was rude an arrogant and stated to me that The FBI could not do anything unless Long Beach California police department contacted them. So like I said I could not believe an organization of Law Enforcement that is Paid by Taxpayer Dollars from the American taxpayers would be so Arrogent and Uncaring, I researched on the web the FBI for Long Beach California and was directed to Los Angeles Division of the FBI.
The Female Agent at Los Angeles California was very caring and understanding when I explained my situation to her. Then she stopped me and told me to hold on a Second. You see My father had just called the Los Angeles FBI office 10 minutes earlier so that would have been Just Before 10:00pm Pacific Time last night since Georgia is on Eastern Time and stated the her that he had Escaped from his kidnappers and was in the Downtown Los Angeles California area. So if anyone sees a man in the Los Angeles California or Long Beach California matching the description and photo below please contact Missing Persons Division of The Long Beach Police Department, Detectives Johnson or Turner at 562-570-8810,562-570-1446 or562-570-7260, Your Local Police Department or 911.
My Fathers Description
He is a White Male 82 Years of age, Approximately 6' 2" Confined to a Wheel Chair, But he may be limping or struggling to walk if his wheel chair is not available. If he has his wheel chair it has a Green Bottom Area and he will have a Black backpack attached to it. He usually wears a Basecap with a Flag in the background and an Eagle in the foreground on the front of the Baseball cap. He has a Scar on his Nose from surgery.
